Supreme
Court Decides in Favor of Direct Shipping
Las
week the US Supreme Court ruled that states must be consistent
in their direct shipping laws regarding wine. The ruling basically
says that a state must treat an out-of-state winery the same as
they do an in-state winery. So for states that allow wine shipments
to consumers from in-state wineries, but prohibit shipments from
out-of-state wineries, the state must allow all or allow none.
The
ruling did not immediately open up any new states to direct shipping
of wine. The battle now moves to the state legislatures for them
to enact/revise their laws. Many people believe that most of the
states in question will open up to out-of-state wineries. This
is good news for smaller wineries and for consumers who like these
wines.
